By using this website, you affirm and certify that you have read and agree to our Disclaimer and Terms and Conditions of Use.

While every effort is made to ensure the accuracy of the information on this website and other information provided to you by Certus, portions of this information may be incorrect or out-of-date. Neither Certus nor its affiliated companies, their officers, directors, employees, agents, information providers or suppliers warrants the accuracy, reliability, or timeliness of information provided and shall not be liable for any losses caused by such reliance on the accuracy, reliability, or timeliness of such information.

This website is not intended for anyone under the age of 13. If you are under 13, you are not permitted to submit personal information or register for our services.

By using this website you agree that neither Certus nor its affiliated companies, their officers, directors, employees, agents, information providers, or suppliers shall have any liability to you under any theory of liability or indemnity in connection with your use of this website or the services of Certus.

Notwithstanding the foregoing paragraph, the total liability of Certus, if any, for losses or damages shall not exceed the fees paid by the user for the particular information or service provided. In no event shall Certus be liable to you for any losses or damages other than the amount referred to above.

Use of any products or services provided by Certus constitutes acknowledgment that you have read and understand these terms of use. By using this website, you expressly agree that Certus will not be held liable for or responsible for any damage or inconvenience caused or alleged to be caused by the use of our services.

Our courses include course elements as required by the state regulating agency for that course, which can include course expiration dates, course timers, learning assessments and identity validation requirements. Students who are excluded from training for failure of any required course elements will be required to re-register to complete training.

Americans with Disabilities Act (ADA) and Reasonable Accommodation

In compliance with the Americans with Disabilities Act and to ensure equal employment opportunities to qualified individuals with a disability, Certus will make reasonable accommodations for the known disability of an otherwise qualified individual. A reasonable accommodation for an employee means a modification to the role that would enable an employee to complete the role despite a disability or condition and does not cause undue hardship to Certus. At Certus we take the privacy of all visitors to our websites very seriously. This Privacy Notice (“Notice”) informs you how the Certus handles privacy matters and processes your personal data.

How We Use your Information/Sharing and Disclosure

  • To facilitate, operate, and provide our Service, specifically to deliver training to you and create your account with us related to that training. This includes authenticating your identity which allows access to our Services, and to provide assistance and support for our Services.
  • To support and enhance our data security measures, including for the purposes of preventing and mitigating the risks of fraud, error or any illegal or prohibited activity.
  • Where we need to comply with a legal or regulatory obligation based on the Services we provide, like driver’s education, workplace safety training, and/or continuing education, In those instances, we may have to share student data with state or federal agencies as part of our course or exam completion reporting.
  • To facilitate and optimize our marketing campaigns, ad management and sales operations, and to manage and deliver advertisements for our products and services more effectively, including on other websites and applications and providing referral codes. Such activities allow us to highlight the benefits of using our Service, and thereby to increase your engagement and overall satisfaction with our Service. This includes contextual, behavioral and interests-based advertising based on activity, preferences or other data available to us or to our Partners;

We share your information in the following ways.

    We may utilize Facebook Custom Audience, Google Customer Match and/or LinkedIn Matched Audience platforms which enables us to display personalized ads to persons on our email list when they visit those respective platforms. We provide Personal Information such as your email address, address and phone number to the social media provider to enable it to determine if you are a registered account holder. You may opt-out of participation in this program by contacting us as noted below. You may also opt out of receiving these ads from the social media network directly.

  • Business Transfers. We may engage in a merger, acquisition, bankruptcy, dissolution, reorganization, or similar transaction or proceeding that involves the transfer of the information described in this Notice. In such transitions, customer information is typically one of the business assets that is transferred or acquired by a third party. Storing your personal data/Transfer of Data

This site is operated in the United States. If you are located in another jurisdiction, please know that your information will be transferred to, stored, and processed in the United States. By using this site and providing us with information, you consent to this transfer, processing and storage of your information in the United States. It is important to note that the privacy laws in the United States may not be as comprehensive as those in other countries such as the European Union.   • We may transfer data that we collect from you to locations outside of headquarters for processing and storing. In addition, it may be processed by staff operating outside the office area who work for us or for one of our suppliers. Personal Information We Collect about California Consumers

Additional Notice for California Consumers – This part of our Privacy Notice applies to consumers who reside in California.

We describe the personal information we have collected from consumers in the twelve (12) months preceding the effective date of this Privacy Notice in the part of our Privacy Notice titled, “Information We Collect” above. The information we collect includes the following:

Disclosures of Personal Information for Monetary, Other Valuable Consideration, or for Business Purposes

Certus does not “sell” your personal information as we understand that term to be defined by the California Consumer Privacy Act and its implementing regulations. We do however provide your information to those companies we have contracted with to help provide some part of our services. We don’t intend for our services to be used by anyone under 13 and don’t knowingly collect or disclose data of individuals under 13.

We have disclosed personal information in all or substantially all of the categories identified in this Additional Notice for California Resident Consumers for various business purposes and as a service provider. For more information about what all we disclosed and the entities we disclosed to and why, please see “Information We Share” above.

Your California Privacy Rights

If you are a California resident, you have the following rights. We will honor requests received to the extent required by applicable law and within the time provided by law.

At this time, there is no worldwide uniform or consistent industry standard or definition for responding to, processing, or communicating Do Not Track signals. Thus, we are unable to respond to Do Not Track signals.

We use reasonable administrative, logical, physical and managerial measures to safeguard your personal information against loss, theft and unauthorized access, use and modification.
